Using this Website indicates that you accept these terms and conditions together with our Privacy Policy, regardless of whether you choose to register with us or not. If you do not accept these terms and conditions, do not use this Website.
These Conditions apply to use of this Website and are the conditions on which We will supply any of the Products to You; by placing an Order You agree to be bound by these Conditions. By ticking the ‘I have read and accepted the Terms & Conditions’ button at the end of our customer registration process, you mark your acceptance of these Conditions. Please understand that if You refuse to accept these Conditions, You will not be able to order any Products from the Website. The Conditions applicable to the purchase of Products offered for sale through this Website and the equivalent conditions for sale through Pretty Nerdy Ltd shops and elsewhere shall be mutually exclusive.
When using the Website, You accept that communication with Us will be mainly electronic. We will contact You by email or provide You with information by posting notices on the Website. 3. Terms of Sale
By placing an order you are offering to purchase a product on and subject to the following terms and conditions. All orders are subject to availability and confirmation of the order price.
Dispatch times may vary according to availability and any guarantees or representations made as to delivery times are subject to any delays resulting from postal delays or change to events outside of our control for which we will not be responsible. Please see our delivery charges at the bottom of the page for further information.
In order to contract with Pretty Nerdy Ltd, you must be over 16 years of age and possess a valid credit or debit card issued by a bank acceptable to us. Pretty Nerdy Ltd retains the right to refuse any request made by you, and Pretty Nerdy Ltd reserves the right to close your Pretty Nerdy Ltd account at its sole discretion. If your order is accepted, we will inform you by email and we will confirm the identity of the party which you have contracted with.
This will usually be Pretty Nerdy Ltd or may in some cases be a third party. Where a contract is made with a third party Pretty Nerdy Ltd is not acting as either agent or principal and the contract is made between yourself and that third party and will be subject to the terms of sale which they supply you. When placing an order, you undertake that all details you provide to us are true and accurate, that you are an authorised user of the credit or debit card used to place your order and that there are sufficient funds to cover the cost of the goods. The cost of foreign products and services may fluctuate. All prices advertised are subject to such changes. Please be aware that some of the goods sold through our Websites may not be suitable for children under 16 years of age, so please take extra care when purchasing goods as gifts, for under 16’s.

Pricing and Availability

  1. Whilst we try and ensure that all details, descriptions and prices which appear on this Website are accurate, errors may occur. If we discover an error in the price of any goods which you have ordered, we will inform you of this as soon as possible and give you the option of reconfirming your order at the correct price or cancelling it. If we are unable to contact you, we will treat the order as cancelled. If you cancel and you have already paid for the goods, you will receive a full refund. Where applicable, prices are inclusive of VAT. Delivery costs will be charged in addition; such additional charges are clearly stated where applicable and included in the 'Total Cost'. We are under no obligation to provide the Product to you at the incorrect (lower) price, even after We have sent you a Dispatch Confirmation, if the pricing error is obvious and unmistakable and could have reasonably been recognised by you as a miss-pricing.
  2. The Service may contain typographical errors or other errors or inaccuracies and may not be complete or current. We therefore reserve the right to correct any errors, inaccuracies or omissions and to change or update information at any time without prior notice. We reserve the right to refuse to fill any orders that you may place based on information on the Service that may contain errors or inaccuracies, including, without limitation, errors, inaccuracies or out-of-date information regarding pricing, shipping, payment terms, or return policies.

Upon receiving your order, we carry out a standard pre-authorisation check on your payment card to ensure there are sufficient funds to fulfil the transaction. Goods will not be dispatched until this pre-authorisation check has been completed. Your card will be debited once the order has been accepted.

Only one promo/student discount code can be used per order.

  1. Prohibitions

You must not misuse this Website. You will not: commit or encourage a criminal offence; transmit or distribute a virus, trojan, worm, logic bomb or post any other material which is malicious, technologically harmful, in breach of confidence or in any way offensive or obscene; hack into any aspect of the Service; corrupt data; cause annoyance to other users; infringe upon the rights of any other person's proprietary rights; send any unsolicited advertising or promotional material, commonly referred to as "spam"; or attempt to affect the performance or functionality of any computer facilities of/or accessed through this Website. Breaching this provision would constitute a criminal offence under the Computer Misuse Act 1990. Pretty Nerdy Ltd will report any such breach to the relevant law enforcement authorities and disclose your identity to them.

We will not be liable for any loss or damage caused by a distributed denial-of-service attack, viruses or other technologically harmful material that may infect your computer equipment, computer programs, data or other proprietary material due to your use of this Website or to your downloading of any material posted on it, or on any website linked to it.

The use of automated systems or software to extract data from this Website for commercial purposes, ('screen scraping') is prohibited without license.

The intellectual property rights in all software and content made available to you on or through this Website remains the property of/or its licensors and are protected by copyright laws and treaties around the world. All such rights are reserved by Pretty Nerdy Ltd and its licensors. You may store, print and display the content supplied solely for your own personal use. You are not permitted to publish, manipulate, distribute or otherwise reproduce, in any format, any of the content or copies of the content supplied to you or which appears on this Website nor may you use any such content in connection with any business or commercial enterprise.

You shall not modify, translate, reverse engineer, decompile, disassemble or create derivative works based on any software or accompanying documentation supplied by Pretty Nerdy Ltd.

7.UK Consumer Contracts Regulations 2013

The Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013 (UK) advise you have fourteen calendar days to cancel the contract for your order with us and we will issue you with a full refund for the items you have purchased and the cost of standard delivery if you've paid for shipping.

  • The fourteen calendar days start from the day after you receive your order.
  • If you are looking to return an item under this legislation, please contact info@prettynerdy.co.uk and email a scanned copy of your withdrawal form included in your order.

8.Returns Policy

  • Items must be returned within 14 days of receipt of goods
  • Items must be returned unworn and unwashed.
  • Items must have all tags attached.

- You can return unsuitable items within 14 days of receipt. Please return unsuitable items in their original packaging. 
- Unfortunately, we are unable to offer free returns, returns must be made at your own cost. 
- Please note it can take up to 7 working days for the payment to show in your account, depending on the card issuer.

HOW LONG DOES IT TAKE TO PROCESS MY RETURN?

It may take up to 14 working days for your refund to be processed after you have returned your item(s) to us. If you have not been refunded after 14 days of returning the item(s), please contact us on info@prettynerdy.co.uk with the proof of postage information from your return carrier receipt and we will investigate this.

 9.Our liability

We warrant to You that any Product purchased from Us through the Website is of satisfactory quality and reasonably fit for all the purposes for which products of the kind are commonly supplied.

Our liability for losses You suffer as a result of Us breaching this Contract is strictly limited to the purchase price of the Product at the time of Purchase. However, any Product found to be unfit for purpose or faulty will be eligible for a refund of return postage up the original cost of dispatch postage (please see Returns info). We will not be liable to You in contract, tort, or otherwise, for any loss of profits, loss of business, loss of anticipated savings, loss of opportunity, loss of data or any other indirect or economic losses whatsoever suffered or incurred by You arising out of the subject of these Conditions. Nothing in these Conditions shall limit our liability for death or personal injury resulting from Our negligence or that of Our servants, agents or employees, under section 2(3) of the Consumer Protection Act 1987, for fraud or fraudulent misrepresentation or for any matter for which it would be illegal for Us to exclude, or attempt to exclude Our liability.

You agree to indemnify, defend and hold harmless Pretty Nerdy Ltd, its directors, officers, employees, consultants, agents, and affiliates, from any and all third party claims, liability, damages and/or costs (including, but not limited to, legal fees) arising from, without limitation, your breach of these terms and conditions, your infringement of any intellectual property right or any other right of any person or entity, or your breach of any duty of confidence or privacy, or any defamatory statements made by you in any form.

11.Waiver

If We fail, at any time of the Contract, to insist upon strict performance of any of Your obligations under the Contract, or if We fail to exercise any of the rights or remedies to which We are entitled under this Contract, this shall not constitute a waiver of such rights or remedies and shall not relieve You from compliance with such obligations. A waiver by Us of any default shall not constitute a waiver of any subsequent default. No waiver by Us of any of the terms and conditions of the Contract shall be effective unless it is expressly stated to be a waiver and is communicated to You in writing.

12.Governing Law and Jurisdiction

These terms and conditions are to be construed in accordance with the laws of England and in the event of any dispute or claim associated with these terms and conditions, that dispute or claim shall be subject to the exclusive jurisdiction of the English courts.

13.Entire Agreement

The above Terms of Service constitute the entire agreement of the parties and supersede any and all preceding and contemporaneous agreements between you and Pretty Nerdy Ltd. Any waiver of any provision of the Terms of Service will be effective only if in writing and signed by a Director of Pretty Nerdy Ltd.

14.Variation

Pretty Nerdy Ltd shall have the right in its absolute discretion at any time and without notice to amend, remove or vary the Services and/or any page of this Website.

15.Invalidity

If any part of the Terms of Service is unenforceable (including any provision in which we exclude our liability to you) the enforceability of any other part of the Terms of Service will not be affected all other clauses remaining in full force and effect. So far as possible where any clause/sub-clause or part of a clause/sub-clause can be severed to render the remaining part valid, the clause shall be interpreted accordingly. You grant to Pretty Nerdy  Ltd and its affiliates and/or related entities a worldwide, perpetual, irrevocable, royalty-free, non-exclusive, transferable right to use your video(s), photo(s) and/or other content posted to Instagram, Facebook, Twitter, Youtube, Linkedin, Pinterest together with your social media handle, social media user name, profile picture, caption and location information you may have included in your content (“User Content”) that you have tagged with any of the Hashtag(s) defined below in any media, including but not limited to on its webpages and social media pages, retailer sites, third party sites, stores for its marketing and/or its advertising. You grant Pretty Nerdy Ltd the right to use your username, real name, image, likeness or other identifying information in connection with any use of your User Content.

The Pretty Nerdy Ltd may use, display, reproduce, distribute, transmit, combine with other materials, alter and/or edit the User Content for legal and/or regulatory reasons in any way it sees fit (while maintaining the original sentiment), with no obligation to you whatsoever.

You may directly upload User Content or post User Content to your social media accounts. By uploading User Content and posting User Content that you have tagged with Brand hashtags to social media platforms, you grant to the Brand, its third-party service providers who provide content management service (collectively, the licensed parties) the worldwide, perpetual, irrevocable, royalty-free, fully-paid, non-exclusive, transferable right to use your uploaded or Brand-tagged User Content in any manner to be determined in the Licensed Parties’ sole discretion, including but not limited to on its webpages, social media pages operated by the Licensed Parties, promotional e-mails and advertisements, and in other marketing, promotional and advertising initiatives, in any media now or hereafter known. The Licensed Parties may use, display, reproduce, distribute, transmit, create derivative works from, combine with other materials, alter and/or edit your User Content in any manner in their sole discretion, with no obligation to you whatsoever.   • From time to time, we may offer promo codes which may apply to any, or certain specified purchases made through the Pretty Nerdy Ltd Website.
  • Each Promo Code will be subject to specific terms & conditions specified at the time the promo code is issued (including the length of time to use the code) in addition to those mentioned in these Terms of Use.
  • Only one promo code can be used against an order at any one time.
  • A promo code can't be applied to an order after that order has been place unless explicitly stated.
  • A maximum spend limit of £1500 (or equivalent local currency) pre-discount applies per order.
  • Certain brand or product category exclusions may apply so we’ll let you know if you can't use your promo code on anything before you complete your purchase.
  • If the promo code has expired, you won’t be able use it.
  • We’re afraid we can’t accept any responsibility once we have given you a promo code and we are not obliged to provide you with a replacement if it gets lost and/or gets used by someone else as this will result in the promo code being cancelled.
